1. Eligibility: The Medtronic Foundation’s Science Museum of Minnesota family membership Sweepstakes (the "Sweepstakes") is open to legal residents of the 50 United States and the District of Columbia. If winner is under age of 18, prize will be awarded to winner’s parent or legal guardian.
Employees and agents of Medtronic and the Medtronic Foundation, affiliates; subsidiaries; advertising, promotion, and fulfillment agencies; (collectively, “Sweepstakes Entities”); and each of their immediate family members and persons living in their same household, are not eligible to participate in the Sweepstakes. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules & Regulations ("Official Rules"). VOID WHERE PROHIBITED.
2. How To Enter: You may enter the Sweepstakes in one of two ways:
(a) Visit the Medtronic Foundation Science Alliance website at www.medtronicsciencealliance.org and enter your information
(b) Enter by mail, hand-write or type your name, mailing address, phone number and date of birth on a 4"x6" card and mail to: Science Museum of Minnesota Family Membership Sweepstakes, Medtronic Foundation, 710 Medtronic Parkway, Minneapolis, MN 55432
Mail-in entries must be postmarked by October 1, 2008 and be received by October 15, 2008.
No mechanically reproduced mail-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods. Proof of delivery or receipt of an entry will not be deemed proof of entry. Any attempted form of entry other than as described herein is void.
3. Grand Prize Drawing: All Sweepstakes entries meeting the requirements of these Official Rules will be entered into the prize drawing, to be held on or about October 16, 2008 by the Medtronic Foundation, whose decisions are final and binding in all matters relating to this Sweepstakes. Five (5) Grand Prize winners will receive a one-year “Family/Household” membership to the Science Museum of Minnesota. Winners will be notified by via a telephone call from the Medtronic Foundation or via mail. Limit one prize per person, per household.
4. Prizes and Odds: The prizes to be awarded from the Sweepstakes are as follows:
(a) Five (5) Grand Prizes: a one-year “Family/Household” membership to the Science Museum of Minnesota. Approximate retail value (“ARV”) $89 (U.S.). Total ARV for all prizes is $445.
Grand prize can be administered for winner in person or via phone or e-mail. Prize is not transferable or redeemable for cash and prize substitutions will not be allowed, except at sole discretion of the Sponsor who reserves the right to substitute a prize of equal or greater value. Any difference between the stated prize value and actual prize value will not be awarded if winner is unable to accept prize as stated, Grand Prize will be forfeited in its entirety.
Odds of winning prize depend on the total number of eligible entries received. Winner (or if a minor, his/her parent of legal guardian) is solely responsible for any and all federal, state and local taxes that apply to the prize. No cash or other substitution of prize is permitted, except at the sole option of Sponsor, for a prize of equal or greater value.
5. Notification of Winner: Winner will be notified by phone or mail. Grand Prize winners will be required to sign and return an affidavit of eligibility and publicity/ liability release. If a prize winner is a minor in their state of residence, a parent/ legal guardian will be required to sign and return all required documents within the time requirement indicated. Winners will have fourteen (14) days from the date notification is sent to return the completed releases. Failure to comply with this requirement will result in disqualification and an alternate winner will be selected. If a selected Winner cannot be contacted; is ineligible; fails to claim a prize; prize or notification is returned as undeliverable; and where applicable, an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, prize may be forfeited and an alternate Winner will be selected from remaining valid, eligible entries.
6. Privacy Policy: Any personal information supplied by you to the Medtronic Foundation will be subject to the Medtronic Foundation’s privacy policy posted at http://www.medtronic.com/statements/privacy. Other than terms included but not limited to those described in “Additional Conditions,” the Medtronic Foundation will not sell, rent, transfer or otherwise disclose your personal data to any third party.
7. General Rules and Conditions: By entering, you agree to be bound by these Official Rules. The Sweepstakes is offered and hosted by the Medtronic Foundation, which is not responsible for late, lost, delayed, damaged, postage-due, incomplete, illegible, or misdirected entries, responses, or other correspondence, whether through the website or postal mail or otherwise, or for theft, destruction, unauthorized access, or alterations of entry materials; or for phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures, or difficulties. By participating and winning or accepting a prize, Winner releases the Medtronic Foundation, and its respective affiliates, subsidiaries, directors, officers, employees, sponsors, and agents, including dealers, advertising and promotion agencies, independent judging organization, from any and all liability with respect to the Sweepstakes or the acceptance, possession or use of any prize, including without limitation (i) any condition caused by events beyond the Medtronic Foundation’s control that may cause the Sweepstakes to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes (including, but not limited to, liability for any property loss, personal injury or death); and (iii) any printing or typographical errors in any materials associated with the Sweepstakes. The Medtronic Foundation’s decisions in all respects relative to the Sweepstakes are final. The Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes in whole or in part, for any reason, but in particular in the event of fraud, technical or other difficulties or if the integrity of the Sweepstakes is compromised, without liability to the entrant. The Sponsor reserves the right to disqualify any winner, as determined by the Medtronic Foundation in its sole discretion. The winner (or if a minor, his/her parent or legal guardian) is responsible for paying all applicable taxes, including income taxes, on the value of the prize received. Void where prohibited or restricted by law. All federal, state and local regulations apply.
8. Additional Conditions: Except where prohibited, by accepting any prize and granting permission, Winner consents to the use of his or her name, photo and likeness, biographical information, winning entry and statements attributed to Winner (if true) for advertising and promotional purposes without additional compensation. All entries become property of the Medtronic Foundation and none will be acknowledged or returned. Allow 6-8 weeks for delivery of prize.
